SUBSCRIPTION TERMS & CONDITIONS
Harharts Service Station, Inc RULES:
Harharts Service Station, Inc of Northampton, PA on 13 E 21st St started its subscription program (the "Program") to recognize and reward our fiercely loyal guests. If you want to take advantage of our offers, rewards and other benefits (“Rewards”) that we offer to members of the Program, then you must agree to these terms and conditions ("Rules").
ELIGIBILITY:
You may subscribe in the Program if: (a) you are a legal resident of the United States, (b) you are at least 18 years of age at the time you subscribe or enroll, (c) you have an active e-mail address, (d) you have an active telephone number ( mobile cell number), and (e) you are a human being. Only human beings may subscribe in the Program. No corporations, partnerships, limited liability companies, trusts, or other legal entities may subscribe.
SUBSCRIBING: (Optional: Enrolling*)
To subscribe in the Program, use the "card-less" option available to you on the signup page. The email address you use to subscribe with identifies you as a Program member.
*Once you subscribe and have gained account access as an additional option you may also choose to enroll to receive star rewards.   For star rewards you can enroll here on the MY REWARDS page once you have accessed your account before you can start earning or redeeming star rewards. Please be patient: It may take our computer system up to 24 hours for you to connect to a customer account on file before you can enroll in our optional star rewards.
Subscribing (Optional: Enrolling*) in our Program is simple:
  1. Go to the signup page and follow the prompts.
  2. Enter the email address that you want to use for your Harharts Service Station, Inc Program e-mail address / password login.
  3. If you also want to enroll in the (optional) star rewards, once you have verified your email address and gained account access you will need to visit the MY REWARDS page and separately agree to those terms and conditions.
  4. Enter your first and last name.
  5. As another option you can also agree to join our text club by entering your telephone number (mobile) and agreeing to any applicable carrier charges that may apply.
  6. Click the box to indicate that you “agree” to these Rules and tell us what information you’d like to receive from us by opting in or out of the preference methods offered to you.
  7. Verify your e-mail address by clicking on the link we send you to the e-mail address you provided.
  8. Verify your phone number, by replying to the text/SMS message we send you. That's it!
We will use your contact information to keep in touch with you in the ways you select when you subscribe in the Program. If your contact information changes, or if you wish to change your contact information or the method by which we send you messages (e.g., start having us send messages to your mobile phone number), please log into the signin page and update your contact information or preferences.
If any information you provide us is not truthful, accurate and complete, we may block you from subscribing in the Program, or we may cancel your subscription in the Program. Each household is permitted to register only one subscription account. If Harharts Service Station, Inc finds that you have registered multiple email addresses or you have created multiple Program Accounts, we may cancel your membership in the Harharts Service Station, Inc Program, de-activate all of the Harharts Service Station, Inc subscriptions you have registered, and cancel all Program Accounts you have created. Further, Harharts Service Station, Inc may refuse to allow you to re-enroll in the Harharts Service Station, Inc Program.
We do not anticipate having to limit the number of people that we will allow to subscribe in the Program, but we reserve the right to do so.
We do not charge you a fee to subscribe or enroll in the Harharts Service Station, Inc Program or to remain a subcriber of the Harharts Service Station, Inc Program.
 
KEEPING IN TOUCH WITH YOU:
As a part of the Program, Harharts Service Station, Inc will call you with or send to you informational and marketing messages to the contact information that you provide as part of your registration, such as messages informing you of improvements we make to the Harharts Service Station, Inc Program, new Rewards you may earn, Rewards you have earned that may be ready to expire, new offers you may want to try, and events happening at Harharts Service Station, Inc. Please tell us how we may stay in touch with you by clicking on the appropriate PREFERENCE box or boxes in the “MY PROFILE” section of your subscription account access.
Contacting You on Your Mobile Telephone Number
You may opt-in to allow Harharts Service Station, Inc to send you text/SMS messages to the mobile telephone number that you provide when you signup. NOTE: By opting in to receive text/SMS messages you are also opting in to receive autodialed and prerecorded informational and telemarketing calls. Harharts Service Station, Inc will not send you autodialed and prerecorded informational and telemarketing calls at this time. We reserve the right to do so in the future if you opt in to receive those messages. This is optional...You are not required to opt-in to allowing Harharts Service Station, Inc to send you telemarketing calls and text/SMS messages to your mobile telephone number to become or remain a Harharts Service Station, Inc Program member. By providing us your mobile telephone number and opting-in to such calls and text/SMS messages, you represent that you are the owner of the mobile telephone associated with that mobile telephone number and that you are responsible for controlling access to that mobile telephone. You agree to notify Harharts Service Station, Inc of any change to your mobile telephone number. If you opt-in to receive autodialed and prerecorded calls or text/SMS messages from Harharts Service Station, Inc and then change your mobile telephone number, you agree that Harharts Service Station, Inc may continue to send autodialed and prerecorded calls or text/SMS messages to you at the new mobile telephone number unless you opt-out as described below. Depending on the terms of your service agreement with your mobile telecommunications service provider (“TSP”), voice, message, and data charges may apply to the autodialed and prerecorded calls and text/SMS messages that Harharts Service Station, Inc sends to your mobile telephone number.
How to Stop Text/SMS Messages
  1. If you wish to stop receiving text/SMS messages from Harharts Service Station, Inc , reply to any of our text/SMS message with “STOP” at anytime
  2. You may also opt-out by going to your PROFILE PAGE when you signin by signing in to your account and updating the PREFERENCES checkboxes with your relevant choices.
  3. If you opt-in to receive text/SMS messages from Harharts Service Station, Inc and later opt-out of receiving text/SMS messages from us, you agree that Harharts Service Station, Inc may send a text/SMS message to your mobile telephone number to confirm that you have opted-out of receiving text/SMS messages from us.
  4. You can also reply to our text/SMS message with “HELP” to obtain additional information about these Rules.
Contacting You by E-mail and Postal Mail
As a condition of subscribing in the Harharts Service Station, Inc Program, you agree that Harharts Service Station, Inc may send you marketing and informational messages by e-mail and postal mail to the e-mail address and to the postal address associated with your Harharts Service Station, Inc Program account (“Program Account”). If at any time you no longer wish to receive such marketing and informational messages, you may cancel your Program Account by opting out at anytime by clicking the UNSUBSCRIBE ALL link from any email, or by clicking the UNSUBSCRIBE ALL button from your MY PROFILE page. Please note that if you unsubscribe from the Program email list, Harharts Service Station, Inc will de-activate your Program subscription account and you will forfeit all Rewards, stars, coupons, offers, and other benefits of being a Harharts Service Station, Inc Program subscriber that you may have earned.
PRIVACY
We will use the information you provide us when you subscribe and when you update your information in the manner described in our privacy statement. You may read our Privacy Policy by clicking on the privacy statement link where it appears on this Website. If we revise our Privacy Policy, then these Rules will automatically refer to that revised Privacy Policy once we publish it on our Web site.
You will need your verified e-mail address and Program password to access your Program Subscription Account. You are responsible for keeping the information you use to access your Program Account (i.e., the password for your Program Account) private and secure. If someone besides you learns your Program Account password, and uses your password to access your Program Account, then you will be responsible for any actions that person takes as to your Program Account.
THE BENEFITS OF BEING LOYAL
We give our loyal subscribers (a member of the Program) rewards and/or coupons just for being loyal, or for simply having a birthday. Program may also give reward stars for enrolling, visiting our facility, etc. or send you specials and other coupons for various other reasons. You can track the coupons and Reward stars you have already earned by logging into your Program Account at the signin page and entering your e-mail address and your Account password.
A Coupon or reward may be any of the following:
  • A FREE item
  • $ OFF any item or transaction
  • % OFF any item or transaction
  • $ AMOUNT savings on an item or transaction
  • Other things that entitle you to discounts, or savings
We may make certain rewards and coupons available only for a limited time and we reserve the right to change the discounts or values at anytime.
CHANGES TO THE PROGRAM:
The rewards, coupons or offers you do not redeem will remain on your subscription account until you use them or until they expire, whichever occurs first.
We have the right at any time, with or without giving you prior notice, to:
  • end the Program and/or any specific Reward;
  • change any Reward or other Program benefit we offer;
  • change the requirements for earning a particular Reward;
  • change the time you have in which to earn a particular Reward; and
  • change any other feature of the Program.
If we decide to end the Program or update the rewards program, we will attempt to provide you notice either by e-mailing you at the e-mail address listed in your Program Account or by posting a notice on your MY REWARDS page. However, our failure to notify you that we are ending the Program or that we are ending a specific Reward plan will not give you any right to require us to continue the Program or the specific Reward after the date we end the Program or the specific Reward plan. Neither will our failure to notify you obligate us to compensate you for any Rewards, coupons or other offers that you do not use before we end the Program or the specific Reward plan. Rewards, coupons and offers you accumulate under the Program have no cash value. If we end the Program, Rewards and coupons you have earned but not used will expire on the end date, and you may not redeem any Rewards, coupons or offers after the end date.
To the extent permitted by law, when you subscribe in the Program, you waive your rights under any law that may require us to obtain judicial permission to change these Rules or to end the Program.
RESTRICTIONS:
  • Each person that subscribes in the Program must subscribe using a unique e-mail address, and a unique phone number.
  • Rewards, coupons and other offers are non-transferable and may not be shared with other family members, friends or other Program members.
  • Each eligible person (1 account per household) may subscribe for the Program only one time using one unique email address, i.e., one Program Account per household per unique email address.
HOW AND WHEN MEMBERSHIP MAY END
You may cancel your Program Account at any time by clicking on the “unsubscribe” link in any Program email message or by signing into your account on the signin page and clicking on the "UNSUBSCRIBE ALL" button on your MY PROFILE PAGE. As soon as you cancel your Program Account, Harharts Service Station, Inc will de-activate your Program subscription account and you will forfeit all Rewards, coupons, and any other benefits of being a Program member that you may have earned.
We may cancel your Program if we determine that you are not eligible to be a member of the Program or that you have violated these Rules. We may cancel some or all of your earned Rewards, coupons and other offers if we determine that you received the benefits due to an error, through fraud or deception, or in any manner not consistent with these Rules.
LIMITATION OF LIABILITY
In this Limitation of Liability section of the Rules, Harharts Service Station, Inc and its parent company, subsidiaries, their directors, officers, employees, agents, and Harharts Service Station, Inc's franchisees and their parent companies, subsidiaries, directors, officers, employees, and agents are referred to as the “Harharts Service Station, Inc Parties.” By subscribing and participating in the Program, you agree that, to the fullest extent permitted by law, none of the Harharts Service Station, Inc Parties shall be liable to you for: (1) any claim, loss, injury, damage, delay, accident, cost or expense, including attorney's fees, arising out of or related to the Program, these Rules, or the Program Website; (2) any incidental, indirect, special, punitive, exemplary or consequential damages, arising out of or related to the Program, these Rules, or the Website, (3) any failure, delay or decision by the Harharts Service Station, Inc Parties in administering the Program; (4) any use of your Program subscription account by a party that you did not authorize to use your Program; (5) any representation, claim, offer or statement we make about the Program; and (6) your use and acceptance of any Rewards you receive through the Program. You further agree that in no event will the Harharts Service Station, Inc Parties be liable to you for more than $50 in the aggregate on account of all wrongful acts or omissions by the Harharts Service Station, Inc Parties arising out of or relating to the Program.
WHICH STATE'S LAW CONTROLS
The law of the state of PA, without regard to its conflict of laws rules, will govern your subscription, enrollment and participation in the Program and our performance of our obligations under the Program. You and we agree to bring any action against the other party that arises out of the Program only in the state and federal courts of appropriate jurisdiction located in the state of PA.
If applicable law prohibits us from offering the Program to you, then you may not subscribe or enroll in the Program. If applicable law prohibits us from offering you a feature of the Program, then we may either not offer you that feature of the Program or cancel your membership in the Program.
CHANGES TO THE RULES
We may change these Rules from time to time as we deem appropriate, with or without providing you prior notice of the change. If we change the Rules, then the revised Rules will be substituted for these Rules on the date the revised Rules go into effect. If the revised Rules require you to accumulate more stars to earn a Reward than the prior Rules, or the revised Rules provide that a Reward (coupon or other benefit) will expire sooner or have a lesser value than the Reward (coupon or other offer) would have expired or been valued at under the prior Rules, then the revised Rules govern.
